Thank you for choosing SOS Ticket for your ticket dispute. It is important to take the next steps to give you the best possible odds in the dispute process.

1 Signature of the SOS mandate

It is important to send us the completed and signed agreement to ensure that there are no misunderstandings. This document with your lawyer ensures a predictable and agreed to relationship.

Also send us a copy of your ticket, a copy of your driver’s license and any other documents you receive from the court.

2 Sending the non-guilty plea

It is your responsibility to send in your non-guilty plea. It is important to check the non-guilty box, sign and date the form. Do not send any explanations or comments, even if there is a space for doing so.

3 SAAQ

We will request your driving record from the SAAQ, but the record will be mailed to your address. Please send us a copy of this letter as soon as you receive it.

4 Waiting

Once we have a copy of your ticket, we will send a notice to let the prosecution know that we are the law firm that will be handling your file.

This part can be long, but don’t worry, it’s normal. During this time, you keep the demerit points that are “in dispute” until there is a judgment in your case. The length of time it takes to receive the court date varies from one municipal court to another, and can take up to 18 months.

5 Receiving the court date (Avis d’audition)

This part is important because eventually the court will give you an appointment to go before a judge and plead the case or negotiate the case with the Crown Attorney. As soon as you receive this notice, send us a copy to make sure that your court date is on our calendar.

6 Legal analysis of the file

The legal analysis of the file is only done when we receive the requested evidence from the prosecution. Why is this done? Only then can all the elements of the file be compiled. The ticket alone is not sufficient to ensure a legal defense.

7 Call from the lawyer

The lawyer will study your file, which will consist of your report, the police report, your driving record, and any other relevant information. He or she will contact you to decide on the next step, which he or she will suggest based on your case. Expect to receive a call from your lawyer approximately 2 weeks before your court date.

8 Negotiating with the attorney

The window of opportunity to negotiate is in the two weeks prior to the hearing. Depending on your decision, the lawyer may speak with the prosecutor and try to negotiate the best possible deal for your case. Please note that a result is not a guarantee in any way. Out-of-court settlements can range from the removal of the ticket to the reduction of certain numbers of demerit points. The case is settled when the prosecutor and your lawyer agree on a common point and it is accepted by the judge.

9 Trial

If the lawyers cannot reach a negotiation out of court or if you do not wish to settle the case out of court, the option of going to court to argue our case is available. There will be a preliminary consultation with your lawyer to ensure that the trial goes smoothly.

10 Outcome of the case

You will receive a report by mail from the court. You will receive a final invoice for the negotiation, if any.

Before paying the notice of judgment received by the court, call us to verify with your lawyer that the result is in accordance with the agreement.
